DUNCAN, District Judge.
On April 14, 1950 the Alcohol Tax Unit raided the premises at 519 Tracy Street in Kansas City, Missouri, and seized all of the property libeled, except the 1949 Lincoln which was seized at a different place. At the time of the raid, Charles Carrollo, Tony Marcella, Sam Tortorice and Michael Arnone were arrested and charged *216with conspiracy to violate §§ 3116 and 3253, Title 26 U.S.C.A. The parties arrested were engaged in the business of wholesale liquor dealers without having paid the special tax.
