OPINION

GOLDBERG, Senior Judge.

This case concerns Plaintiff Libas, Ltd.’s (“Libas”) claim for attorneys’ fees and costs from Defendant United States pursuant to 28 U.S.C. § 2412(d), the Equal Access to Justice Act (“EAJA”). Libas brought the original action to challenge a United States Customs Service 1 (“Customs”) classification of fabric imported by Libas from India.
