This is an appeal by plaintiffs-appellants, Pamela Singleton and a group of similarly situated Hamilton residents, from a decision of the Butler County Court of Common Pleas sustaining the defendant-appel-lee’s, city of Hamilton’s, motion for judgment on the pleadings. Appellants filed suit claiming appellee failed to enforce a general city charter provision 2 relating to public health in connection with the storage and subsequent escape into the environment of hazardous chemicals and pollutants from the Chem-Dyne Corporation (hereinafter “Chem-Dyne”) waste disposal site in Hamilton, Ohio.…
