In this appeal we are called upon to determine the statutory jurisdiction of the Division of Occupational Safety and Health (Division) over mines in California.

Labor Code section 6307 invests the Division with “the power, jurisdiction, and supervision over every employment and place of employment in this state” for the protection of the life, safety and health of employees. Labor Code section 6303, subdivision (a) in turn defines “place of employment” as “any place, and the premises appurtenant thereto, where employment is carried on, except a place the health and safety…
