MEMORANDUM

BARTLE, District Judge.

Plaintiff Andrew Williams (“Williams”) filed for bankruptcy under Chapter 13 of the Bankruptcy Code. 11 U.S.C. § 1301 et seq. In the bankruptcy court, he brought an action against Gelt Financial Corporation (“Gelt”) seeking, among other relief, damages based on violations of the Truth in Lending Act (“TILA”), 15 U.S.C. § 1601 et seq., and a declaration that his rescission of the loan from Gelt was effective.
