The plaintiff has appealed from a judgment rendered against him in accordance with the verdict of a jury which was returned in a suit for damages for the death of Joseph Dempsey as the result of alleged negligence on the part of the defendant in maintaining a defective telephone pole which broke and killed Mr. Dempsey when his automobile backed across a street and ran into the pole. It is asserted the instructions which were given to the jury were prejudicially erroneous.
