Affirming.
Appellant, James Pergram, and Ms brother, Marshall Pergram, were jointly indicted in the Bath circuit court for the murder of Curtis Crouch. Marshall Per-gram was tried and convicted and on appeal to this court the judgment was reversed. Pergram v. Commonwealth, 241 Ky. 387, 44 S. W. (2d) 277. James Pergram filed a motion for a change of venue, which was sustained, and the case was transferred to Rowan county.
