Tbe appellant, Frank Kindrick, and Ms brother, Roe Kindrick, were .Jointly indicted by tbe grand jury of Wayne county for tbe murder of Grover Dodson, and upon their joint trial in the same court appellant was convicted of voluntary manslaughter and sentenced to imprisonment in the state penitentiary for a period of 17 years, hut his brother and codefendant was acquitted, under a peremptory instruction from the court directing such verdict.
