Affirming.
The appellant, Millard Saylor, tried under an indictment charging’ him with the willful murder of Earl Calloway, was found guilty of manslaughter and sentenced to serve seven years in the penitentiary. He has.had two trials. At the first trial he was convicted of manslaughter and sentenced to serve ten years in the penitentiary, but the judgment was reversed on the ground of newly discovered evidence. Saylor v.
