Cook, Judge:

The question presented by this appeal is whether the accused was denied individual military counsel in violation of Article 38(b), Uniform Code of Military Justice, 10 USC § 838.

On December 12, 1973, the commanding officer of the Naval Air Station, Le-moore, California, referred for trial by special court-martial two specifications of larceny of Government property that had been filed against the accused.
