Appeal by defendant from an order of the district court for St. Louis county, Ensign, J., denying its motion for judgment notwithstanding the verdict or for a new trial, after a verdict for $2,500, in favor of plaintiff as administrator of the estate of Erick Engstrom, deceased.

The plaintiff’s intestate, Erick Engstrom, was killed by an explosion of dynamite while at work for the defendant in the excavation of a ditch for its water mains. This action was brought to recover *342the damages sustained by his widow and child by reason oí his death, which was caused by the alleged negligence of the defendant. Verdict for the plaintiff for $2,500, and the defendant appealed from an order denying its alternative motion for judgment or a new trial.
