This case is before this Court on cross-motions for summary judgment pursuant to U.S. CIT R. 56. Plaintiff, Baxter Healthcare Corporation of Puerto Rico (“Baxter”), challenges the United States Customs Service’s (“Customs”) classification of the merchandise at issue under subheading 5404.10.8080 of the Harmonized Tariff Schedule of the United States (“HTSUS”)1, at a duty rate of 7.8% ad valorem as a “synthetic monofilament of 67 decitex or more and of which no cross-sectional dimension exceeds 1 mm”.
