Appellants on or about July 12, 1918, were the owners in fee of certain real property situated in the city of Los Angeles, consisting of an apartment house of 122 rooms and the land upon which the apartment house stood. On that date appellants leased the premises to W. A. Barker and C. H. Barker for a period of 15 years at a monthly rental of $975. The lessees, W. A. Barker and C. H. Barker, however, never took possession, but immediately and as a part of the same transaction the appellants and the original lessees entered into an agreement by which it was provided that…
