On June the 7th, 1905, the defendant insurance company issued to the plaintiffs, Thompson Brothers, a mercantile firm doing business at Van Wyck, in Lancaster County, a policy of fire insurance for six hundred dollars on a stock of general merchandise. On December 24th, 1905, the goods were destroyed by fire and the defendant having refused to pay the policy, plaintiffs brought this action alleging the execution of the policy and the fulfillment of all the conditions therein.
