Appellant was tried by general court-martial convened at Glasgow Air Force Base, Montana, on a charge of rape, in violation of Article 120, Uniform Code of Military Justice, 10 USC § 920, and a charge of housebreaking with intent to commit rape, in violation of Article 130, Uniform Code of Military Justice, 10 USC § 930. He was convicted of the charge of rape and was also convicted of the lesser included offense of unlawful entry, in violation of Article 134, Uniform Code of Military Justice, 10 USC § 934.
