Petitioners were tried jointly by general court-martial upon two charges alleging violations of certain articles of the' Uniform Code of Military Justice. The specifications thereunder charge the commission, jointly and in pursuance of a common intent, of (1) ’ an assault upon Pfc Carol A. Fierce, contrary to Article 128, Uniform Code of Military Justice, 50 U.S.C. § 722, and (2) a violation of Article 134 of the Code, 50 U.S.C. § 728, by committing an assault upon Pfc. Fierce on account of her having previously attended and testified at a summary…
