This case is before the court on a petition for review of a decision of the court of appeals, Oakley v. Fireman's Fund, 157 Wis. 2d 77, 459 *824N.W.2d 461 (Ct. App. 1990). The majority of the court of appeals (Sundby, J., concurring in part and dissenting in part) reversed an order of the circuit court for Dane county, Michael B. Torphy, Jr., Circuit Judge. The circuit court's order, in effect, denied Frederic R. Oakley's (Oakley) motion to recover attorney's fees from American Family Mutual Insurance Company (American Family).
