This was an action brought by the appellee against the appellant on a fire insurance policy to recover for the loss of certain lumber which was destroyed by fire in the ■city of South Bend, on the 29th day of May, 1885. The appellant answered, first, by general denial, and, second, that the policy sued on was one of several, covering the same risk, issued by different companies, and provided that in case of loss the company should be liable for “ no greater proportion of the loss sustained than the sum hereby insured bears to the whole amount insured thereon that said policy provided that any…
