Assumpsit on a policy of insurance on the life of Patrick Ryan, for the benefit of the plaintiff; brought to the Superior Court in New London County, and tried to the jury before Foster, J. Yerdict for the plaintiff, and motion for a new trial by the defendants for error in the rulings of the court and on the ground that the verdict was against the evidence. The case is sufficiently stated in the opinion.

1Opinion of the CourtCarpenter, J.

This is an action on a policy of life insurance. The policy is expressed to be “in consideration of the representations, declarations and covenants contained in the application therefor, to which reference is here made as a part of this contract, &c.” It is further declared that “ This policy is issued and accepted on the following express conditions and agreements: Eirst. That the statements

and declarations made in the application therefor, and on the faith of which it is issued, are in all respects true, &c.” The application therefore is a part of the policy; and the plaintiff’s agreements…
