The plaintiff’s decedent, Frederick D. MacKay, resided in Brooklyn, New York. Early in his business career he entered the employ of E. W. Bliss Company of Brooklyn and in 1931 was first vice-president in charge of sales and contracts made by that company. On December 30th, 1931, he gave to J. Edward Dunn, a local agent for the defendant company, in Brooklyn, an application for a life insurance policy for $50,000, and on the same day was examined by a medical examiner for the company. He was found to be a good physical life insurance risk, being about sixty years of age and in sound health.…
