George R. Thomas died testate in the city of Beaumont on the 16th day of July, 1938, leaving an estate of substantial value, which he devised to his nephews and nieces, and certain other beneficiaries named in his will. His will was duly probated by his independent executors, Dr. B. T. Speck and Otis Fullen, on the 15th day of August, 1938. On the 21st day of August, 1939, appellee, Mark Thomas, instituted this suit in the county court of Jasper county to set aside the order probating the will of George R. Thomas and to contest the will, naming as defendants the beneficiaries in the will and…
