This suit was brought in the court below 4hy QUy Felder, appellant, against Houston '^Transit Company, appellee, because of an a2leg-ed assault and battery committed upon him \yy F. Goodson, bus driver for, and agent, servant, and employee of the appel-lee. The jury found — in answer to three special issues submitted by the court — (1) that B. F.
