This is an environmental law action. Plaintiffs, Trinity Industries, Inc. and Trinity Industries Railcar Corporation (collectively, “Trinity”) bring federal claims under the Comprehensive Environmental Response, Compensation and Liability Act (“CERCLA”), 42 U.S.C. § 9601, et seq., and the Resource Conservation Recovery Act (“RCRA”), 42 U.S.C. § 6901, et seq.1 Trinity also brings state claims under Pennsylvania’s Hazardous Sites Cleanup Act (“HSCA”), 35 Pa.Stat. § 6020.101, et seq., and various common law and contract theories.
