This action was instituted against the owner and his lessee to recover for personal injuries sustained by Agnes Wylie as a result of her jump from the third floor of a burning building, an apartment house in Spokane owned by F. M. Gardner and operated by his lessee, Jessie A. Stewart. At the close of plaintiff’s case, defendant owner’s challenge to the sufficiency of the evidence was sustained, and his motion for directed verdict was granted.
