This is an action brought by the respondent against the appellant, the Oregon Railroad & Navigation Company, and the defendant, Samuel Root, to recover damages for a personal injury alleged to have been caused by the negligence of Root while acting as conductor on one of the appellant’s freight trains. The respondent and the defendant Root were employees of the appellant, the one in the capacity of fireman and the other as conductor.
