Philip Daniel Thomas No. 73, September Term 2018 Criminal Procedure – Appeal – Authority of Trial Court to Resentence Defendant When Sentence is Subject of Pending Appeal – Mootness. After the defendant was resentenced by the Circuit Court following a remand, he appealed that sentence, contending that the new sentence was illegal.
