This case is now before us on motion to strike off a writ of sci. fa. to bring in additional defendants. On May 4,1936, plaintiffs filed suit against the City of New Castle to recover damages alleged to have been caused by a fall on a defective sidewalk. On June 1, 1936, the City of New Castle filed a prascipe for a writ of sci. fa. to bring in, as additional defendants liable over to the city, Eva Brown, Florence Brown Thalimer, Alva Thalimer, Elizabeth W. Moore, Ruth Thalimer, and Howard Thalimer. They were alleged to be all the owners of the real estate containing the sidewalk.…
