ORDER GRANTING IN PART AND DENYING IN PART MOTION FOR SUMMARY JUDGMENT

This matter comes before the court on defendants’ motion for summary judgment, filed October 5, 1990. Jurisdiction is based upon 28 U.S.C.A. § 1332(a) (West Supp. 1990). For the reasons below, defendants’ motion is hereby GRANTED IN PART AND DENIED IN PART.
