The principal issue in this appeal is whether the trial court improperly concluded that the defendant, the department of public health (department), has jurisdiction over land owned by the plaintiff, the town of Wallingford (town), even though the land is not owned by the town’s water division and is not used for water utility purposes pursuant to General Statutes (Rev. to 1999) § 25-321 et seq.
