On August 29, 2008, plaintiffs Brian K. Brewer and Suzanne L. Brewer (collectively “plaintiffs”) filed their first amended complaint (“FAC”) for damages and injunctive relief against defendants Indymac Bank (“Indymac”), Residential Mortgage Capital (“RMC”), and James Chapman (“Chapman”).
