On leave granted, plaintiff, the people of the State of Michigan, appealed from an order of the superior court for the city of Grand Rapids, which order discharged the defendants from prosecution and ordered a return of slot machines seized by the police and in effect dismissed the cause.
Defendants were arrested for a violation of Act No. 328, § 302, Pub. Acts 1931 (Comp. Laws Supp. 1940, § 17115-302, Stat. Ann. § 28.534) (Michigan penal code), which reads in part as follows:
