MEMORANDUM AND ORDER

PRATTER, District Judge.

In this putative class action, Plaintiff Gary Serrano, on behalf of himself and all others similarly situated, sued Sterling Testing Systems, Inc., 1 a credit reporting agency, pursuant to the Fair Credit Reporting Act (“FCRA”), 15 U.S.C. §§ 1681, et seq., for damages resulting from Sterling’s alleged practice of disclosing the existence of outdated arrest records to its clients.
