In this putative class action, Gary Serrano, on behalf of himself and all others similarly situated, sued Sterling Testing Systems, Inc. (“Sterling”), 1 a national employment consumer credit reporting agency, pursuant to the Fair Credit Reporting Act (“FCRA”), 15 U.S.C. §§ 1681, et seq., for damages resulting from Sterling’s alleged practice of disclosing the existence of outdated arrest records of potential employees to Sterling’s clients.
