Sylvan and Pearl Mackie appeal the order awarding damages and granting a permanent injunction to respondent Island County.

The Mackies own several acres of lowland property on Whidbey Island. Humphrey Road, maintained by Island County, abuts their property on the west, and is located within a natural drainway extending from the northwest and across their property. Island County maintains a culvert under Humphrey Road to facilitate the passage of water through the drainway. The outfall of the culvert deposits surface water onto the Mackie property.
