MEMORANDUM OPINION

PETER J. WALSH, Chief Judge.

This opinion addresses the issue of whether a trustee’s status as a bona fide purchaser of real property pursuant to 11 U.S.C. § 544(a)(3) is paramount to the right of an equitable trust beneficiary. 1 Loewen Group International, Inc. (“Loewen”) and Mt. Nebo of the Palm Beaches Memorial Gardens, Inc. (“Mt. Nebo”, collectively with Loewen “Debtors”), are affiliated debtors in these administratively consolidated cases.
