Section 273 of the New York Debtor & Creditor Law (“NYDCL”), available to a trustee through 11 U.S.C. § 544(b), permits the trustee to avoid a constructively fraudulent obligation. The issue presented by the pending motion is whether the trustee can object to a proof of claim based on a “fraudulent obligation” where the statute of limitations has run on the avoidance claim and 11 U.S.C. § 502(d) is inapplicable.
