OPINION

SCHWARTZ, Senior District Judge.

I. Introduction

This case requires the Court to address the applicability of equitable trusts in bankruptcy, “the subject of a contentious, contradictory, and expanding body of case law.” 1 Rodman F. Mudins, Jr., (“Mullins”) appeals a December 29, 1997 final order of the Bankruptcy Court of the Dis trict of Delaware granting summary judgment to Chapter 7 Trustee, Jeoffrey L. Burteh (“Trustee”).
