Defendant assigns as errors the denial of its motions for judgment of nonsuit made at the close of plaintiff’s evidence, and renewed at the close of all the evidence.

*725On 16 December 1956, and prior thereto, defendant was engaged, under contract with the State Highway and Public Works Commission, in the construction of a bridge over a canal on State Highway #99 at a point in Washington County about one mile northwest of the Beaufort County line.
