This matter is before the Court following the trial of the “Complaint Objecting to Discharge Pursuant to § 523 of the Bankruptcy Code and for an Award of Damages” (the “Complaint”) filed by Anthony Wallace {“Wallace” or the “Plaintiff’) against James P. Davis {“Davis” or the “Defendant”). Although Mr. Davis answered the Complaint and received a continuance of the trial date, he failed to appear for trial to defend against the Plaintiffs claims.
