Plaintiff Pasqual R. DiCamillo has brought suit against Defendants Liberty Life Assurance Company (“Liberty Life”) and Marriott International, Inc. (“Marriott”) claiming wrongful denial of disability benefits in violation of the Employee Retirement Income Security Act of 1974 (ERISA). Plaintiff asserts that the defendants failed to provide him a full and fair review of his benefits claim in accordance with the provisions of the benefit plan and the Department of Labor’s 2002 ERISA regulations.
