Plaintiff Cecilia Nichols (“Nichols”) brings this action for wrongful termination of long-term disability benefits against the Prudential Insurance Company of America (“Prudential”), the administrator of her former employer’s long term disability employee benefits plan, pursuant to the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001 et seq. Nichols has moved for judgment on the administrative record, and Prudential has moved for dismissal without prejudice and, in the alternative, summary judgment on Nichols’ claims. Before…
