On December 15, 1924, E. M. Flowers filed Ris petition in the district court of Bryan county, against the Niagara Fire Insurance Company, alleging that on May 31, 1924, defendant, an insurance company, by and through its local agent, H. D. Pierson, and its state agent, made settlement with and agreed to promptly pay plaintiff the sum of $750 in settlement of a claim of plaintiff on loss under a policy of insurance issued by defendant to plaintiff, and accepted proof of loss for said sum; that it was agreed between the parties that out of the sum of $750 there should be paid to…
