BECKER, Circuit Judge. **

Rabb Muhammad was convicted for failure to appear for trial in violation of 18 U.S.C. § 3146. 1 On appeal, he contends that the district court improperly applied the relevant guideline provision, U.S.S.G. § 2J1.6 (1995). That guideline sets a base offense level for failure to appear, see § 2J1.6(a)(2), which is then increased in relation to the maximum penalty for the offense for which the defendant failed to appear.
