SMITH, Circuit Judge.

I. Introduction

On April 12, 2000, a grand jury sitting for the Western District of Pennsylvania returned a two count indictment against defendant Donald G. Jackman, Jr. Count one charged Jackman as a felon in possession of twenty firearms in violation of 18 U.S.C. §§ 922(g)(1) and 924(e)(1). Count two charged Jackman with violating 26 U.S.C. §§ 5861(d) and 5871 by knowingly possessing a destructive device which was not registered to him in the National Firearms Registration and Transfer Record as required under 26 U.S.C. § 5841.
