Petitioner Ascherman, a physician, is plaintiff in two actions for reinstatement of hospital staff privileges. One ease, against the Mount Zion Hospital and Medical Center, is pending in San Francisco. The other, against the Marin Hospital District, is pending in Marin County. The present proceeding tests the propriety of an order of the respondent Superior Court of San Francisco imposing sanctions on Ascherman and his attorneys because of their assertedly unjustified action in subpoenaing two witnesses to appear at the hearing on his motion to compel answers at a deposition.
