MEHRTENS, District Judge:

Roosevelt Carter was convicted on three counts of violating 18 U.S.C. § 1001 (making false statements to an agency of the United States). A directed verdict of acquittal was granted as to a fourth count charging a violation of 18 U.S.C. § 1014.

On appeal, Carter asserts that his prosecution under 18 U.S.C. § 1001 was improper because that statute was impliedly repealed by 15 U.S.C. § 645(a). He also claims that the trial judge erred in denying his motion for a mistrial based on alleged improper questioning of a government witness by the Assistant United States…
