VANCE, Circuit Judge:

Appellee Rolando Anderez was charged in a two count indictment with the violation of the misdemeanor provisions of the Currency and Foreign Transactions Reporting Act (Reporting Act), 31 U.S.C. §§ 1101, 1 1058, 2 and the felony violation of the false statements statute, 18 U.S.C. § 1001. 3 A jury convicted Anderez of both counts. The district court, however, granted Anderez’ posttrial motion for acquittal on the felony false official statements count.
