This is an appeal by the defendants from a judgment of the Superior Court sustaining the plaintiff’s appeal from a finding and award of the workmen's compensation commissioner for the first district denying compensation for claimed partial incapacity.
The parties have stipulated that the facts are as follows: On March 16, 1956, the plaintiff received a compensable injury to his back while he was employed by the named defendant.
