Harvey Chapel died March 2, 1912, leaving as his heirs at law his widow, Julia Chapel, and five sons and three daughters. At the time of his death, he owned a considerable quantity of personal property and several tracts of land all located in Houston county.
In September, 1913, Richard Chapel, one of the sons, brought an action to enforce specific performance of an oral agreement alleged to have been made between himself and his father in September, 1909, whereby his father promised to convey to him the land known and designated as the “Money Creek farm.” Richard made the…
