This patent action is before the Court on several issues: (1) plaintiffs’ and defendant’s respective supplemental briefs regarding whether the recently amended statute, 28 U.S.C. § 1498, (“Section 1498”), applies to plaintiffs’ claim for attorneys’ fees resulting from its long-standing patent infringement litigation; (2) defendant’s motion to dismiss pursuant to Rule 12(b)(1) for lack of subject matter jurisdiction; and, assuming the Court grants plaintiffs’ motion with regard to the applicability of Section 1498 and denies defendant’s motion to dismiss, (3)…
